The regulation for registration as an importer of weighing and measuring devices has been defined in the Legal Metrology (General) Rules, 2011. The provision is defined in Chapter VI, Rules 27 and 29. An importer of measuring instruments willing to enter the Indian market needs to register to obtain the Certificate of Registration of Importer of Weights and Measures.

The ministry of Consumer Affairs released LEGAL METROLOGY (PACKAGED COMMODITIES) RULES, 2011. The law states that every manufacturer or packer needs to follow certain regulations. As per the rules, every individual or organization or any company that wants to manufacture any commodity for sale needs to make an application with a fee of five hundred rupees to the Director of Legal Metrology, Government of India or the Controller for the registration of his name and complete address.

The penalties in the rules are the violation of manufacturing of non-standard Weights & Measures, counterfeiting of seal, short weighment or measurement, use of non-verified weights & measures, not making declarations by the manufacturers on the packaged commodities. The penalty is charged depending upon the nature of offence committed by the accused. The non-compoundable offences are sent to court of law for trial.

These guidelines cover all form, format, or medium of advertising and marketing communications. These regulations also apply to the manufacturer/service provider whose products/services are the subject of the advertising or marketing communications and advertisement agency and endorser (wherever applicable) of the product/service. Thus, any claim made by a brand should be authenticated. All companies are urged to review their current communications to avoid legal consequences in future. Moreover, the draft Guidelines also provide detailed restrictions on advertisements related to children, disclaimers on products and services.
